The Services allow users to access and use a variety of educational material, including learning or practicing the English language. GrammarWay may, in its sole discretion and at any time, update, change, suspend, make improvements to or discontinue any aspect of the Services, temporarily or permanently.

Your Account and Information

To create your user account, we («GrammarWay») need you to provide certain personal information about yourself, including but not restricting to your email address and a password of your choice. By providing your email address, you agree that we may use it to contact you for customer support, confirmations, product or service offers and other issues. You are responsible for keeping your password confidential.

As you use The Services, we gather certain information about you. This information is primarily used to personalize the Services for you and to improve the Services. For more details, refer to our Privacy Policy.

You may request to terminate your account by contacting our customer support team (info@grammarway.com). Upon termination of your user account, we will immediately and permanently delete all personal information that you have given us (including your account information), but we may keep non-personal demographic information, the data that we have gathered as you used the Services.

When you subscribe to our paid Services, you will have the right to request a refund during 14 calendar days from the date of your original purchase. After the expiry of this period, you may still cancel your subscription at any time; there will be no refund but you will be able to use the paid Services until the end of your then-current subscription period, after which your subscription will no longer be renewed. 

GrammarWay reserves the right to restrict access to some or all Services at our discretion. GrammarWay may choose to make certain Services accessible to you only against identification and/or payment.

License to Use The Services

We own the intellectual property rights in The Services and Service Content of «GrammarWay» and «Learn.GrammarWay». You may use the Services and Service Content only for your own personal language learning.

You must not reproduce, redistribute, sell, rent, sublicense, publicly display, publicly perform, make available, modify, transmit or otherwise exploit Service Content outside the Services, whether commercially or not.

You must not use the Services in any way that causes, or may cause, damage to our website or impairment of the availability or accessibility of the Services; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use the Services to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to the Services without our express written consent.

You must not use the Services to transmit or send unsolicited commercial communications. «GrammarWay», «Learn GrammarWay» and all other trademarks, service marks, graphics and logos (collectively «marks») used in connection with the Services are trademarks or service marks of GrammarWay, and certain of such marks may be registered. Nothing in these Terms grants you any right to reproduce or otherwise use these marks.

Payment Processors

All financial transactions made in connection with the Services will be processed by a third party in accordance with their respective terms of use, privacy policy, and/or any applicable payment terms and conditions. We encourage you to learn about the practices of such third party. In no event will GrammarWay be responsible for the actions or inactions of any third party payment processor, including, but not limited to, system downtime or payment service outages. Disclaimers

You agree that your use of the Services is at your own sole risk and that the Services are provided on an «as is, as available» basis, without warranties of any kind, either express or implied. GrammarWay expressly disclaims any and all warranties, express or implied, regarding the Services, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

GrammarWay does not warrant the completeness or accuracy of the information provided through the Services; nor does it commit to ensuring that the Services remain available or that the Service Content is kept up-to-date.

We try to make the Services accessible via most popular web browsers and devices. However, we cannot guarantee that the Services will function properly with all browsers, devices, and network services.

Limitation of Liability

To the extent that the Services and Service Content are provided free of charge, we will not be liable for any loss or damage of any nature.

We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.

Severability

If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

The Services may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by GrammarWay. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from GrammarWay or Learn GrammarWay, you understand that these Terms of Use and our Privacy Policy do not apply to your use of such sites. You expressly acknowledge and agree that GrammarWay shall not be responsible or liable, directly or indirectly, for any damage or loss arising from your use of any third-party website, service, or content.

The Services may include advertisements, which may be targeted to the Content or information on the Service, or other information. The types and extent of advertising by GrammarWay on the Services are subject to change. In consideration for us granting you access to and use of the Services, you agree that GrammarWay and its third party providers and partners may place such advertising in connection with the display of information submitted by you or others.

Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and GrammarWay in relation to your use of the Services, and supersede all previous agreements in respect of your use of the Services.
